Hele LLC d.b.a. CaddieNow (“CADDIENOW” or “We” or “Our”), a Nebraska limited liability company, respects your privacy and is committed to protecting it through our compliance with this privacy policy (this “Policy”).

This policy describes the type of information we may collect from you or that you may provide when you visit the website www.caddienow.com and the online application (collectively, the “Application”), and our practices for collecting, using, maintaining, protecting, and disclosing that information in the provision of services to you (the “Services”).

This policy applies to information that we collect: (a) in the Application; (b) in email, text, and other electronic messages between you and the Application; and (c) through mobile and desktop applications you download from the Application. This policy does not apply to any third-party websites linked from the Application.  Please check the privacy policy on those websites for more information.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Application. By accessing or using the Application, you agree to this privacy policy. This policy may change from time to time. Your continued use of the Application after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

The General Data Protection Regulation, which became effective on May 25, 2018, creates consistent data protection rules across Europe. It applies to all companies that process data about individuals in the European Union. The GDPR imposes responsibilities on “data controllers” and “data processors.” A company is a “data controller” when it has the responsibility of determining why and how personal data is processed. A company is a “data processor” when it processes personal data on behalf of a data controller. CADDIENOW operates as a data controller.

This Policy is designed to address only CADDIENOW’s data practices with respect to activities conducted by CADDIENOW on its own behalf or through the Application. For those activities, CADDIENOW acts as a data controller and may appoint third parties to act as data processors on its behalf, such as Stripe and Bullhorn. CADDIENOW is committed to ensuring that it has appropriate terms in place with such partners so that both CADDIENOW and the partners comply with their respective requirements under the GDPR.

Data controllers must have a legal basis to process your personal information. CADDIENOW’s legal basis to process your information arises from CADDIENOW’s need to use your information to provide you with the Services and customer support and to advance CADDIENOW’s other legitimate interests (including operating the Application, providing requested Services, etc.), as discussed more fully in this Policy. CADDIENOW also relies on your consent in some circumstances as the basis for the processing your personal information.

Collection and Use of Personally Identifiable Information

We take privacy very seriously and are committed to ensuring that our handling of personally identifiable information complies with applicable data protection and privacy laws.  We collect several types of information from and about users of the Application, including the information described in this Policy.  We collect this information directly from you when you provide it to us, automatically as you navigate through the Application, and through location services as you use the Application.  The process of registering and creating a User Account requires the collection from the User of such information as name, company, mailing address, email address, cell phone number, and payment information which may include credit card information. A User also may post a detailed personal profile which may include contact information, biographical information, and a photo (by adults only). Your submission of personally identifiable information to CADDIENOW constitutes your acknowledgement that you have read and understood this Policy and that you consent to our collection, processing, use, storage and disposal of your personally identifiable information in accordance with this Policy.  CADDIENOW does not collect any personally identifiable information from unregistered individuals browsing the public areas of the website or the Application.  However, the CADDIENOW website may log IP addresses for system administration, including to monitor traffic patterns, diagnose server problems, and facilitate delivery of content. IP addresses are not linked to personally identifiable information.

How We Use Your Information

Personally identifiable information will be used by CADDIENOW solely for the provision of the Services on the website and Application.  We use information that we collect about you or that you provide to us, including any personal information: (a) to present the Application and its contents to you; (b) to provide you with the Services that you request from us; (c) to fulfill any other purpose for which you provide it; (d) to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection; (e) to notify you about changes to the Application or any products and the Services we offer or provide through it; (f) to allow you to participate in interactive features of the Application; (g) in any other way we may describe when you provide the information; and (h) for any other purpose with your consent.  We will never sell or disclose your personally identifiable information to unrelated third parties for marketing or commercial purposes, unless we have your prior permission or are required by law.  However, in connection with our provision of Service to you, your personally identifiable information may be accessible by third parties with whom we partner to offer products and services to you, including hosting and maintaining our website, Application or our Services, or who provide billing and other out-sourced services to us. All such service providers commit to complying with our instructions and to keeping all personally identifiable information secure.

Consent to Collection of Service Information

By accepting and using the Service, you consent to allowing CADDIENOW to collect aggregate billing and usage data in the normal course of our business, and to use such information for the purpose of providing Service for the benefit of all Users.

Consent to Release of Personal Information

CADDIENOW may disclose your personal information collected via the Application or in the course of providing a Service to subsidiaries and affiliates, and other contractors and service providers, including, but not limited to, User golfers, caddies, golf courses, and CADDIENOW’s insurance carrier and/or a claims processor as necessary to process a claim involving you that arises from or relates to any use of the Services.  Further, CADDIENOW may disclose your information to fulfill the purpose for which you provide it and for any other purpose disclosed by us when you provide the information.

CADDIENOW may also disclose aggregated information about our users, and information that does not identify any individual, to data aggregators without restriction.

CADDIENOW may also disclose your personal information: (a) to comply with any court order, law, or legal process, including to respond to any government or regulatory request; (b) to enforce or apply our Terms of Use, and other agreements, including for billing and collection purposes; and (c) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of CADDIENOW, our customers, or others.

Online Activity

Cookies. “Cookies” are text files, which may be encrypted, containing small amounts of information that a server may download to your computer or mobile device when you visit a website, use an application, or access an advertisement or widget on a website.  Personal information is not generated by the cookies, but rather by your input of information into website order forms, registration pages, payment pages, other online forms, and your use of the website or application.  When you return to a website or application, your browser retrieves and sends the information in the cookie to the server. Cookies facilitate efficient navigation, identify and remember individual user personal preferences gleaned from use, authenticate log-in information, and gather aggregated user information.  Some cookies, knowns as “Session Cookies,” store a session ID that is not personally identifiable, but only for a particular browsing session.  Such cookies store information about pages you view and allow you to easily navigate, but are deleted from your device when the session is over.  Other cookies, known as “Persistent or Tracking Cookies,” retain user preferences for future browsing sessions by the same user.  Such cookies assign a unique ID to the user’s browser and are not deleted when the browser is closed.  All of the cookies we use are deployed to help our website and Application function.  We do not use cookies to gather information for ad tracking or monetization purposes.  By using our Service, you consent to the use of these cookies and agree that we can place them on your device.  If you do not want our Service to place cookies on your device you can: (i) not use our Service; (ii) delete cookies that have been placed on your device following a browsing session; or (iii) adjust your browser settings to limit or disable cookies.  However, limiting or deleting cookies may adversely affect your ability to use the Service.

Hyperlinks.  Our website and Application may include hyperlinks to other websites or applications.  We have no control over other websites or applications that we do not maintain.  These other websites and applications may be subject to different terms of use and privacy policies and you are fully responsible for becoming familiar with such terms and policies.

Children’s Online Privacy Protection Act

CADDIENOW’s Services, website and Application are not intended for use by children under the age of 13, and we abide by the provisions of the United States’ Children’s Online Privacy Protection Act (COPPA), and other applicable laws relating to the use of children’s data.  We do not knowingly collect or maintain personally identifiable information from children under the age of 13.  If you are under 13, do not use or provide any information on the Application, establish a User Account, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have inadvertently and without authorization obtained any information from a child under 13, please contact us.

California Civil Code Section 1798.83 entitles California residents to request information concerning whether a business has disclosed personal information to any third parties for their direct marketing purposes. Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.  The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Application, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to the Application. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained in the Application.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users' personal information, we will notify you by email to the email address specified in your User Account and/or through a notice on the Application home page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting the Application and this Policy to check for any changes.
